Protective Covenants
For over a decade, the Developer has been a homeowner in the Kilmarnock Head area and has developed a true appreciation for the quality of life, the landscape and natural beauty only an area such as this can offer. This respect for the natural and undisturbed splendor of the area forms the foundation of the Protective Covenants to protect and preserve Kilmarnock Head for the enjoyment of all residents. The Developer welcomes preservation minded homeowners to build their dream house amidst the scenic landscape and call Kilmarnock Head home.
The Kilmarnock Covenants should be considered “protective” rather than “restrictive”. While there are some restrictions on what a lot owner may do, those restrictions are intended to maintain a high standard of architecture and maintenance that will ensure preservation of property values for everyone. Covenant Overview
The lands shall be used for private residential purposes only and no main building other than a detached single-family dwelling shall be constructed on the lands.
Any dwelling on the lands shall have a minimum habitable floor area of 1,200 sq feet excluding garage, patio, porch or other like part of the building.
All buildings constructed on the property must have a minimum setback of 50 feet from the road and no buildings of any nature may be constructed within 25 feet of property boundary unless, in exceptional circumstances and in agreement with the developer, to take advantage of the unique terrain.
Plans and specifications of all proposed buildings, including exterior colors and materials must be submitted and approved by the developer prior to construction.
Once construction has commenced the exterior must be completed within one year.
Nature and physical details of any proposed fence, gate, wall, post or other structure shall be approved by the developer.
No living/healthy trees may be cut, killed or removed from any parcel except when needed to allow for the construction of a dwelling or other building or to facilitate the development of lawns, gardens or the coastal views from the parcel.
Architectural Guidelines
With its unique location and terrain distinguishing it from other developments, protecting and preserving the environment and the “look” of Kilmarnock Head will be the responsibility of each lot owner. Architectural and landscape designs that compliment the existing natural terrain and incorporate natural exterior finishes in local stone, cedar shingles and wood siding in earth tone stains is encouraged for all home owners.
While creative architectural solutions are encouraged to take advantage of the uniqueness of each site, the designs should be architecturally compatible with each other and harmonious with the natural surroundings. The traditional local residential architecture exhibits certain characteristics and features that respond to climate, building shape, function and site. The richness, simplicity and rationality of this regional vernacular should serve as a major reference source for the design of Kilmarnock Head homes.
Some of these features are listed as follows:
Designs, including shape and location of buildings and grounds should take advantage of the existing natural terrain and magnificent views.
The use of windows including dormers, clerestory windows, bay windows and bow windows as well as verandas, balconies, patios and decks are encouraged to allow for outdoor living, to capitalize on views and vistas and to assist with scale and massing.
Where possible, the use of natural materials such as cedar shingles, wood siding and local stone should be incorporated into the design.
Predominate colors are to be selected from warm earthy tones or a muted natural color and light to dark wood tones. No bright paint or roof colors are permitted on any structure.
Homeowners Association
A Kilmarnock Head Home Owners Association (HOA) will be in place to administer the covenants. Each lot owner will contribute an annual amount equal to his/her proportionate share and will have one vote for each lot owned. The monies collected will be used to pay professional management, electricity for streetlights, road maintenance, including plowing, landscaping and other expenses.
